Selective Licensing Policy
Summary of Mansfield District Council’s Selective Licensing Policy (2025)
Mansfield District Council introduced Selective Licensing to raise housing standards, support responsible landlords, and reduce issues such as poor property conditions, deprivation and anti-social behaviour in the private rented sector. The policy sets out how the scheme operates, who is in scope, and what landlords must do to comply.
Purpose of the Policy
The policy sets a clear framework for:
- Improving the condition and management of privately rented homes
- Ensuring landlords are fit and proper persons and competent to manage properties
- Supporting enforcement where housing conditions or tenancy management fall below acceptable standards
- Promoting partnership working to protect vulnerable residents and communities
The policy aligns with Part 3 of the Housing Act 2004 and is supported by our wider enforcement strategy and housing priorities.
Where the Scheme Applies
Licensing applies to privately rented single-let properties (not HMOs) in five designated areas:
- Victoria Street Area (Central ward)
- Howard Road Area (West Bank and Wainwright wards)
- Market Warsop (Market Warsop ward)
- Newgate Lane (Rock Hill and Eakring wards)
- Rosemary Street Area (Central and Bancroft wards)
Designation is based on evidence of housing-related issues and community impact. Detailed maps and street lists are published on our website.
Which Properties Are Included or Exempt
Included: Most single-family rented homes within the designated areas.
Exemptions include:
- Registered social housing
- Certain tenancies (e.g. business or agricultural lets)
- Resident landlord arrangements
- Properties already licensed under other legislation (e.g. HMO licensing, care homes, student halls)
You may apply for a Temporary Exemption Notice (TEN) for short-term situations such as sale, change of use or substantial refurbishment.
Applying for a Licence
You must submit a full online application with:
- Ownership and property details
- Management and repair arrangements
- Tenancy agreements
- Gas/Electrical safety evidence and EPC rating
- Declaration of fit and proper status
- Notification to relevant parties (e.g. mortgage lender)
We will assess whether the applicant is suitable to hold a licence and capable of managing the property to acceptable standards. Processing time is typically 16 weeks.
Licensing Fees
Fees are split into two parts:
- Part A (application): £500
- Part B (granting licence): £300
Discounts:
- £50 off if you apply within the first 3 months
- £100 off for accredited landlords (DASH, NRLA, EMPO) if applying within the first 3 months
Each property requires its own licence. Refunds are limited and only available in specific situations (e.g. if an exemption applies at the time of application).
Fit and Proper Person Test
You (and any managing agent) must pass a legal test confirming:
- No serious criminal convictions (e.g. violence, fraud, drug offences)
- No history of housing law breaches or civil penalties
- No banning orders under the Housing and Planning Act 2016
Knowingly providing false or misleading information may result in prosecution or revocation of your licence.
Property Standards and Inspections
All licensed properties must meet minimum standards, including:
- Annual gas safety certificates
- Five-yearly electrical condition reports
- Smoke and carbon monoxide alarms
- Safe, secure and well-maintained accommodation
- Minimum EPC rating of E
We will inspect each property at least once. Inspections may be unannounced and are supported by enforcement powers under the Housing Act 2004.
Non-Compliance and Enforcement
Failing to license a property or breaching licence conditions is a criminal offence. We may take action including:
- Civil penalties up to £30,000
- Licence revocation or refusal
- Rent Repayment Orders (via First-tier Tribunal)
- Criminal prosecution with unlimited fines
Support for Landlords
We are committed to helping responsible landlords comply. Our offer includes:
- Drop-in sessions and 1:1 guidance
- Access to recognised landlord training
- Information about financial support or grants
- Landlord forums and newsletters to keep you informed
If you haven’t completed relevant training in the last 3 years, you must do so within 12 months of receiving your licence.
Monitoring and Complaints
We monitor licensing performance monthly and publish annual reports. The scheme will be formally reviewed after three years. If you have concerns about a Council service, you can submit a complaint through our Corporate Complaints Policy. A separate process is in place for licensing appeals.
