Planning Appeals

Making an Appeal

If you are the applicant and disagree with the decision of the Council on a planning application, the condition(s) attached to a decision, or that the Council have not made a decision within the prescribed time (8 weeks, or 13 weeks in the case of a major application) you can lodge an appeal with the Planning Inspectorate. An appeal has to be lodged with the Planning Inspectorate within 6 months of the decision date, except for Householder Appeals which need to be lodged within 12 weeks of the decision date.

The period for lodging an appeal against failure of an Local Planning Authority to determine an application including applications for non-material changes to planning permissions begins after the expiry of 28 days.

Appeals submitted outside the prescribed limits will normally be turned away by the Inspectorate.

Householder Appeal Service

The Householder Appeal Service is intended to bring a quicker, more proportionate appeals service to householders, many of whom have found the appeal process confusing and lengthy. The Planning Inspectorate aim to issue a decision on these appeals within 8 weeks. Further information can be found on the Planning Portal  web site.

What is a 'Householder' appeal?

A "householder" appeal is one against the refusal of planning permission for development attached to a residential property or within its boundary.

It does not include:

In the event of an Householder applications appeal there will be no further opportunity to make representations to Mansfield District Council, any comments received will be sent directly to the Secretary of State.

Making an Appeal on-line using the Planning Casework Service

The Planning Casework Service lets users submit certain types of appeal on-line, together with supporting documentation. To make an appeal on-line please use the following link to the Appeals page of the Planning Portal  web site.

You can also track the status of appeals, view relevant correspondence, see the location on a map and make comments on-line. To view or use this system, visit the Planning Portal's On-Line Appeal Service.

Current Appeals at Mansfield

Use the View Appeals link to access information on current appeals within Mansfield District held in our on-line database. From the home page click the "Search and view current appeals" link will list all the applications lodged with Mansfield District Council that are currently subject to an Appeal. From here you can view the application details and also the progress and status of the Appeal. Information is provided from our live planning database, this is continually updated and is transferred to our Internet server at the end of every working day, this means the information you view is accurate as of the previous working day.
