Fined for unauthorised rubbish dump
Mansfield District Council is urging people to carry out checks when hiring others to get rid of their waste after a man was prosecuted and fined for failing to ensure that his waste was disposed of correctly.
Mr Frank Wayne (48) of Outgang Lane, Mansfield Woodhouse, was fined £400 and ordered to pay costs of £307.43 along with a victim surcharge of £15 by Mansfield Magistrates. The waste, which consisted of household waste and parts of domestic appliances, was found illegally dumped on Eakring Road, Forest Town, on 3 May 2011.
Mr Wayne pleaded guilty to failing to check that household waste produced on his property was given to an authorised person when he appeared at Mansfield Magistrates' Court on Wednesday 25 January 2012.
He told Council Officers that he had given the waste to "scrap men" and did not expect them to fly-tip it. However, Mr Wayne admitted that he did not carry out any checks to establish that they were authorised to take his waste.
Councillor Mick Barton, Portfolio Holder for Public Protection, said: "I hope this prosecution acts as a reminder that fly-tipping doesn't just refer to dumping waste directly - it is also an offence to allow someone to remove your waste before carrying out the proper checks.
"This case shows that failing to dispose of waste properly is illegal and will not be tolerated. The Council will always seek to take legal action against those responsible for fly-tipping."
