Conditions / Reason for Refusal: (1) Condition: The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

(2) Condition: This permission shall be read in accordance with the following plans: Plan and elevations Drg No. PARKHALL- 01 Rev A. received 10/07/12. Block Plan Drg. No. PARKHALL – 02 Received 29/05/12. Location Plan. Drg. No. PARKHALL – 02 Received 29/05/12. and the Email received from the applicants on 18/07/12. The development shall thereafter be undertaken in accordance with these plans unless otherwise agreed in writing by the Local Planning Authority.

(3) Condition: No development shall commence until details of the proposed external facing materials, and the treatment of the proposed timber cladding to be used have been submitted to and approved in writing by the Local Planning Authority. The development thereafter shall be undertaken in accordance with the approved details.

(4) Condition: No development shall commence until details of the proposed roofing material to be used have been submitted to and approved in writing by the Local Planning Authority. The development thereafter shall be undertaken in accordance with the approved details.

(5) Condition: Building operations shall not be commenced until details of the surface water and sewage disposal proposals serving the site have been submitted to and approved in writing by the Local Planning Authority. The development thereafter shall be undertaken in accordance with the approved details.

(6) Condition: Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987 (as amended), the hereby approved ancillary refreshment and toilet block shall only be used by persons fishing at Park Hall Fisheries identified within the blue line on the approved site location plan and staff working in connection with the facility. No other person shall use the hereby approved facility without the prior written consent of the Local Planning Authority.

(1) Reason: In accordance with Section 91(1) of the Town and Country Planning Act 1990, as amended by S51(1) of the Planning and Compulsory Purchase Act 2004.

(2) Reason: To define the permission, for the avoidance of doubt.

(3) Reason: In the interests of visual amenity and to accord with Saved Policy BE1 (28/09/07) of the adopted Mansfield District Local Plan.

(4) Reason: In the interests of visual amenity and to accord with Saved Policy BE1 (28/09/07) of the adopted Mansfield District Local Plan.

(5) Reason: To ensure that the development is provided with a satisfactory means of drainage as well as to reduce the risk of creating or exacerbating a flooding problem and to minimise the risk of pollution.

(6) Reason: The use of the premises for any other purposes will require further consideration by the Local Planning Authority.

SUMMARY OF REASONS FOR DECISION The application has been considered within the context of paragraph 28 of the National Planning Policy framework and Saved Policies NE1, LT11 and LT18 [28/09/07] of the adopted Mansfield District Local Plan, and would appear to comply with the policies and criteria contained there-in. In the opinion of the Local Planning Authority, there are no other material planning considerations to be taken into account that would warrant a decision at variance with the above. Summary of relevant Policies. National Planning Policy Framework. (NPPF) - Paragraph 28 seeks to support a prosperous and sustainable rural economy through options including sustainable rural tourism and leisure facilities. Mansfield District Local Plan 1998. Saved Policies [28/09/07]. NE1 - Presumes against developments outside of the urban boundary unless one of a number of criteria are met, including outdoor recreational and tourism uses in keeping with the rural character of the area. LT11 - Presumes in favour of a Country park at Park hall,/Manor Park. LT18 - Presumes in favour of tourism facilities providing a number of criteria are met. Regard has been given to the following articles where applicable in consideration of this application. The Council’s Solicitor & Monitoring Officer is happy to advise on the application of the Human Rights Act should any particular issue arise.
