Conditions / Reason for Refusal: (1) Condition: The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

(2) Condition: This permission shall be read in accordance with the following plans: Site location plan, received on 22/05/12 Ecological Impact Assessment, received on 22/05/12 Route of SWA cable, received on 22/05/12 CCTV tower details, received on 22/05/12 CCTV tower foundation details, received on 22/05/12 The development shall thereafter be undertaken in accordance with these plans unless otherwise agreed in writing by the Local Planning Authority.

(1) Reason: In accordance with Section 91(1) of the Town and Country Planning Act 1990, as amended by S51(1) of the Planning and Compulsory Purchase Act 2004.

(2) Reason: To define the permission, for the avoidance of doubt.

SUMMARY OF REASONS FOR DECISION In the opinion of the Local Planning Authority, the proposal is in accordance with the objectives of the National Planning Policy Framework 2012 and Saved Policies BE1, NE1, NE4 (C) and U8 [28/09/2007] of the Adopted Mansfield District Local Plan 1998, meeting the relevant objectives and criteria. The proposed siting, height and appearance of the mast is considered to be acceptable in this location and the development will not have an adverse impact upon protected species within the surrounding area. There are no other material considerations that indicate that a decision should be taken at variance with the above policies. Summary of relevant policies National Planning Policy Framework – sets out the necessary evidence required in support of telecommunications proposals and states that Local Authorities must determine applications on planning grounds. Saved Policy BE1 (28/09/07) – This policy aims to ensure developments achieve a high standard of design. Saved Policy NE1 (28/09/07) – Sets out the criteria that proposed development outside of the urban boundary should meet. Saved Policy NE4(C) – States that planning permission will not be granted for developments which would detract from the open character of sensitive gaps between Forest Town and Clipstone. Saved Policy U8 - states that planning permission will be granted for telecommunication installations provided that mast or site sharing is undertaken where possible, the design and siting of equipment housings minimises visual impact and cables are sited underground.

(2) Note to Applicant The applicant’s attention is drawn to the recommendations contained within the Ecological Impact Assessment and is advised that the legal requirements of the Wildlife & Countryside Act 1981 (as amended) must be met with regard to any protected species that may be found on site during construction of the mast or laying of the cable. Further assistance on this matter can be obtained from Natural England or Nottinghamshire Wildlife Trust.
