SUMMARY OF REASONS FOR DECISION
In the opinion of the Local Planning Authority, the proposal, as restricted by conditions, is in accordance with Saved Policies E3, M16, BE1, BE3, BE5, BE6, MTC7 [28/09/2007] of the adopted Mansfield District Local Plan and advice contained within the NPPF sections 2 and 12. The development will not cause a detrimental impact upon the character and appearance of the Listed Building, the wider Market Place Conservation Area, the vitality and viability of Mansfield town centre or highway safety and there are no other material considerations that indicate that a decision should be taken at variance with the above policies.
SUMMARY OF RELEVANT POLICIES
Saved Policy E3 – Advises planning permission will be granted for employment uses within the urban boundary providing all of a set of 6 criteria are met.
Saved Policy M16 – Advises planning permission will be granted for new developments provided proposals meet 6 sets of criteria in respect of transport / movement issues.
Saved Policy BE1 – Advises planning permission will be granted for developments which achieve a high standard of design, listing four sets of criteria.
Saved Policy BE3 – Advises that Listed Building Consent / Planning Permission will only be granted for alterations/additions/ changes of use of listed buildings where this would not adversely affect its character, architectural merit or historical interest.
Saved Policy BE5 – Supports the beneficial reuse of listed buildings.
Saved Policy BE6 - Advises planning permission will be granted for developments within conservation areas provided they meet all of a set of criteria.
Saved Policy MTC7 – Advises planning permission will be granted for retail, non residential institutions and leisure uses within the sub regional centre.

(1) Condition: The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

Appendix A General Specification for Alterations to Charter Arms received 12/04/2012
The development shall thereafter be undertaken in accordance with these plans unless otherwise agreed in writing by the Local Planning Authority.
(3) Condition: No development shall commence until full details including design, construction and RAL colour of the proposed replacement external door on the south eastern elevation have been submitted to and approved in writing by the Local Planning Authority. The development thereafter shall be undertaken in accordance with the approved details.
(4) Condition: No development shall commence until a method statement for the widening of the existing door on the south eastern elevation has been submitted to and approved in writing by the Local Planning Authority. The development thereafter shall be undertaken in accordance with the approved details.
(5) Condition: No development shall commence unit a sample of the proposed replacement slate roof tiles has been submitted to and approved in writing by the Local Planning Authority. The development thereafter shall be undertaken in accordance with the approved details.
(6) Condition: The building shall be re rendered using a lime render mix. Prior to the commencement of any works on site, a sample panel of render shall be made available for inspection and approval by the Local Planning Authority. The development thereafter shall be undertaken using the approved lime render mix.
(7) Condition: The render shall be painted using breathable paint. No development shall commence until full details of the proposed colour and finish including RAL number of the breathable paint have been submitted to and approved in writing by the Local Planning Authority. The development thereafter shall be undertaken in accordance with the approved details.
(8) Condition: Replacement timber shall match existing timber and be installed using ‘spliced in’ techniques.
(1) Reason: In accordance with Section 91(1) of the Town and Country Planning Act 1990, as amended by S51(1) of the Planning and Compulsory Purchase Act 2004.
(2) Reason: To define the consent for the avoidance of doubt.
(3) Reason: The building is listed as being of special architectural or historic merit, and as such, the Local Planning Authority would require a high standard of finish to the external elevations, in accordance with Saved Policies BE1 and BE3 (28/09/07) of the adopted Mansfield District Local Plan.
