Conditions / Reason for Refusal: SUMMARY OF REASONS FOR DECISION The application has been considered within the context of Saved Policy MTC8 [28/09/07] of the adopted Mansfield District Local Plan 1998, and would appear to comply with the criteria contained there-in. The application has also been considered within the context of the national Planning Policy Framework, and would appear to comply with paragraph 23. In the opinion of the Local Planning Authority, there are no other material planning considerations to be taken into account that would warrant a decision at variance with the above. Summary of relevant policies. National Planning Policy Framework. Paragraph 23 recognises that residential properties can play an important role in ensuring the vitality of centres providing they are located in appropriate sites. Mansfield District Local Plan Saved Policies. MTC8 presumes in favour of uses other than retail, including housing, at first floor level and above in primary and secondary shopping areas.

(1) Condition: The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

(2) Condition: This permission shall be read in accordance with the following plans: Proposed conversion of residential flats at second floor level, floor plans, received 15/05/2012. Proposed conversion of residential flats at second floor level, rear elevations and sections, received 15/05/12. The development shall thereafter be undertaken in accordance with these plans unless otherwise agreed in writing by the Local Planning Authority.

(1) Reason: In accordance with Section 91(1) of the Town and Country Planning Act 1990, as amended by S51(1) of the Planning and Compulsory Purchase Act 2004.

(2) Reason: To define the permission, for the avoidance of doubt.

(1) Note to Applicant This permission is solely in respect of the change of use and replacement staircase. The subsequent approval of the Local Planning Authority may be required for any external alterations to the premises, including alterations to the windows, rooflights etc.
