Planning applications can be granted subject to one or more conditions, dependent on the type or nature of the application.

What is a planning condition?

The majority of planning permissions have conditions attached. Some conditions require approval by the council before any development takes place, others can be discharged during the course of the development. All conditions relating to a planning permission can be viewed on the decision notice.

Request to discharge conditions

It is very important that all the conditions attached to a planning decision are complied with and this is known as discharging the conditions. Failing to do so may lead to enforcement action being initiated against the applicant or even the invalidation of the planning permission.

To request to discharge conditions, you can complete the application using the planning portals on-line submission service or download and complete the application for removal or variation of a planning condition form using the planning portal's form chooser.

Two copies of all documents/plans relating to each condition to be discharged should be submitted and it should clearly identify the condition number(s) it relates to. The appropriate fee must be provided with the request.

Submissions will only be processed once all details and the fee have been received.

Failure to discharge a condition could stall a development and lead to enforcement action or invalidate the planning permission. Please see our enforcement policy for action we can take.

Timescale

If the matter is straightforward, you have supplied all the details we need and your proposals are acceptable, we should be able to give you a response in about eight weeks. If we need to consult other people, it may take eight to twelve weeks to respond.

If the details are insufficient or unacceptable, we will inform you within twelve weeks that the condition(s) cannot be discharged. You would then have to resubmit new proposals for compliance with a further fee.

If we cannot confirm that the condition is (or is not) complied with within twelve weeks of receipt of necessary details and the fee, we will refund your fee.
